Terms and Conditions for the Solution Book of the Website Check

1. Provider
1.1 The provider is iweb4u Aliquò, sole proprietorship, owner Antonio Aliquò, Resedastrasse 8, 9404 Rorschacherberg, Switzerland (hereinafter "iweb4u"). Phone +41 71 558 93 55, email info@iweb4u.ch, VAT number CHE-137.019.655 MWST.
2. Scope
2.1 These General Terms and Conditions (T&C) apply to the purchase of the solution book via the website check on www.iweb4u.ch and on www.ai-with-milo.com ("AI with Milo"), in all language versions of the checker.
2.2 The offer is aimed at businesses, self-employed persons and organisations. By purchasing, the customer confirms that they are concluding the contract for their professional or commercial activity.
2.3 Other services of iweb4u, such as the optimisation of a website, the Website Guardian, web design or white-label licences, are subject to separate agreements.
2.4 Deviating terms of the customer apply only if iweb4u agrees to them in writing.
2.5 These T&C are available in German and in an English translation. The German version prevails, even if the customer uses the checker in another language.
3. Service
3.1 Solution book: The solution book applies to one domain. For the checked website, it contains ready-made files, code snippets and text suggestions, for example for robots.txt, llms.txt and the company profile according to schema.org, as well as step-by-step instructions for the detected website system and a link with which the customer can pass the book on to their web designer.
3.2 Unlocking: During the term, the website check and the PDF report are unlocked for this domain, without a fixed limit on the number of checks within the scope of normal use. If the domain redirects to another domain, the unlocking also applies to the target of the redirect.
3.3 Up to date: The solution book is based on the most recent check of the website and adapts to the current state after each new check.
3.4 Extent: The check and the solutions concern the checked address, usually the home page, as well as the files of the domain such as robots.txt, sitemap.xml and llms.txt. Subpages are not checked individually.
3.5 Implementation: The solution book is a guide to self-help. The customer or their web designer makes the changes to the website. Implementation by iweb4u is not part of this offer and can be commissioned separately.
3.6 Achievable score: The achievable score shown in the check and in the solution book is a calculation using the same scoring as the check. It assumes that all solutions are implemented in full and depends on the website system, the hosting provider and the implementation. It is not a warranty.
3.7 No promise of success: iweb4u does not warrant any particular rankings in search engines, any mentions in answers from AI systems or any visitor or sales figures. These depend on third parties, such as search engines and providers of AI systems.
3.8 Further development: iweb4u continuously develops the checker and its check rules. As a result, scores may shift. Section 7.5 applies to the Progress Guarantee.
4. Conclusion of the contract
4.1 The solution book can only be purchased after a successfully completed check.
4.2 The contract is concluded as soon as the customer has completed the payment on the Stripe payment page.
4.3 Unlocking usually takes place immediately after payment. The customer receives a confirmation with a receipt at the email address they provided when paying.
5. Price and payment
5.1 The price is a one-off price and depends on the customer's country. In Switzerland and Liechtenstein it is CHF 180.00, including 8.1% value added tax. In the other countries of Europe it is EUR 179.00, in all other countries USD 199.00, in each case without Swiss value added tax. The price displayed at the time of purchase is decisive.
5.2 The checker suggests the currency based on the time zone of the browser. Outside Switzerland and Liechtenstein, the customer can choose between EUR and USD. If the customer's registered office or domicile is in Switzerland or Liechtenstein and they nevertheless pay in EUR or USD, the amount paid is deemed to be the price including 8.1% value added tax.
5.3 For customers whose registered office or domicile is outside Switzerland and Liechtenstein, iweb4u does not charge Swiss value added tax. The customer accounts for taxes and duties in their own country themselves, for example value added tax under the reverse charge procedure.
5.4 Payment is made in advance via the payment service Stripe, by credit or debit card, Apple Pay or Google Pay, and in Swiss francs also by TWINT. The customer enters the payment details directly with Stripe. iweb4u does not receive any card or account details. Fees charged by the customer's bank or card issuer, for example for conversion into another currency, are borne by the customer.
5.5 The purchase does not establish a subscription. The contract is not renewed automatically.
6. Term and access
6.1 The term is 12 months from payment. If the customer purchases again for the same domain during the term, the term is extended by a further 12 months from its previous end.
6.2 When the term expires, the unlocking and access to the solution book end without notice of termination being required. The customer can print the solution book or save it as a PDF beforehand.
7. Progress Guarantee
7.1 If the customer fixes an open point from their report according to the solution book, the checker counts this item as fixed at the next check. iweb4u stands behind this with the Progress Guarantee: if the checker does not count an item that has demonstrably been fixed, or if the website can no longer be checked during the term, iweb4u refunds the full purchase price.
7.2 Individual solutions bring less than a whole point and only take effect together with others. The decisive factor for the guarantee is therefore the scoring of the fixed item, not the overall score.
7.3 The guarantee applies during the term of 12 months from the purchase.
7.4 An item has demonstrably been fixed if the change is visible on the website and appears in the checker's before-and-after report.
7.5 If iweb4u changes the check rules, an item fixed according to the solution book continues to count as fixed.
7.6 The guarantee does not apply if the hosting provider, the website system or an upstream protection service, such as a firewall or bot protection, blocks access by the checker. Nor does it apply to changes that do not correspond to the solution book.
7.7 The customer asserts the guarantee by email to info@iweb4u.ch, stating the domain and the item concerned. iweb4u reviews the case and responds within 10 working days.
7.8 The refund is made in the currency of payment via Stripe to the original means of payment. If this is no longer possible, for TWINT for example after 180 days, iweb4u transfers the amount to a bank account of the customer. With the refund, the unlocking and access to the solution book end.
8. Credit towards the optimisation
8.1 If the customer commissions iweb4u within 12 months of the purchase to optimise the same website, iweb4u credits the purchase price paid towards the price of the optimisation. For this purpose, the confirmation contains a personal voucher code. If payment was made in EUR or USD, iweb4u credits the equivalent value in Swiss francs on the day of payment.
8.2 The voucher code is tied to the customer and the domain. It is not transferable, is not paid out in cash and does not apply to the Website Guardian or other offers.
8.3 After a refund under section 7, no credit is possible.
9. No right of return
9.1 The solution book is provided digitally immediately after payment. There is therefore no right of return or withdrawal. The Progress Guarantee under section 7 remains reserved.
10. Obligations of the customer
10.1 The customer confirms that they are the owner of the domain or have been instructed by the owner to have the website checked and changed.
10.2 The customer backs up their website before making changes and uses files and code at their own responsibility. They check suggestions such as page titles, descriptions and company details for accuracy before adopting them.
10.3 The customer does not misuse the checker, in particular not for automated mass queries.
11. Rights of use
11.1 The customer may use the solution book for the purchased domain and pass it on to persons working on their website, such as their web designer, their agency or their hosting provider.
11.2 Use for other domains, resale and use in an offer of one's own are not permitted. iweb4u offers separate white-label licences for agencies.
11.3 The customer may use files and code that they deploy on their website there without time limit.
12. Availability
12.1 iweb4u operates the checker with due care but does not warrant uninterrupted availability. Maintenance work and disruptions are possible, including with third-party services used by the checker.
13. Liability
13.1 iweb4u is liable for damage it causes intentionally or through gross negligence. Any further liability is excluded to the extent permitted by law, in particular for slight negligence, for indirect and consequential damage, for loss of profit and loss of data, and for damage arising when implementing the solutions on the website.
13.2 iweb4u is not liable for the services of third parties, such as hosting providers, providers of website systems, payment services and search engines.
13.3 Insofar as liability exists and the law permits, it is limited to the purchase price paid.
14. Data protection
14.1 iweb4u processes personal data in accordance with the Swiss Federal Act on Data Protection. In addition, the privacy policy at www.iweb4u.ch/en/datenschutz.html applies, and for purchases via www.ai-with-milo.com the privacy policy at www.ai-with-milo.com/privacy/.
14.2 For the purchase, iweb4u processes the checked address and the result of the check, the customer's name, company and email address, the amount, currency, time and method of payment without card or account details, the country of the billing address, the selected language, the time zone of the browser for suggesting the currency, and the IP address at the time of purchase.
14.3 iweb4u uses this data to process the contract, unlock the domain, issue the receipt, review the guarantee and the credit, keep the accounts and prevent misuse. iweb4u adds the customer to its customer management and may contact them about the implementation and about suitable offers of its own. The customer may object to this at any time by email to info@iweb4u.ch.
14.4 Payment is processed by Stripe. Stripe processes the payment data in accordance with its own privacy policy (stripe.com/privacy). Data may be transferred to countries outside Switzerland, in particular to the USA. For payments with TWINT, TWINT AG is also involved.
14.5 The solution book can be accessed via an address that contains the address of the checked website. It only shows information that is publicly accessible on the checked website.
14.6 iweb4u retains the data for as long as is necessary for these purposes. iweb4u retains documents relevant for accounting for the statutory period of 10 years.
14.7 The customer may request information about their data and have incorrect data corrected. Requests should be sent to info@iweb4u.ch.
15. Changes
15.1 iweb4u may change these T&C. A purchase is governed by the version published on www.iweb4u.ch or on www.ai-with-milo.com at the time of purchase.
16. Final provisions
16.1 Should any provision of these T&C be invalid, the remaining provisions remain valid. The invalid provision is replaced by a provision that comes as close as possible to its purpose.
16.2 Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
16.3 The place of jurisdiction is Rorschacherberg, Switzerland.
